Suspended with Pay vs Leave of Absence

We required employees to have a valid driver's license as a condition of employment. If an employee has a suspended license, we issue a non-disciplinary leave of absence due to the fact they are unable to fulfill their employment contract. Does the use of the word "leave of absence" and not suspension provide us any more security from a claim of constructive dismissal?
